In our 546th issue:

* EFF SEEKS TO HELP RIGHTHAVEN DEFENDANTS

The Electronic Frontier Foundation is seeking to assist
defendants in the Righthaven copyright troll lawsuits.
Righthaven has filed hundreds of copyright infringement
lawsuits seeking to shake down bloggers and others for
stiff copyright damages. Righthaven has developed a lawsuit
business model based on searching the internet for stories
and parts of stories from newspapers, purchasing the
copyright for the stories and suing the online location
that republished all or part of the stories. EFF believes
that many of those sued may have strong fair use and other
defenses.

* EFF's CINDY COHN WINS IP VANGUARD AWARD FROM STATE BAR OF
 CALIFORNIA

We're pleased to announce that EFF's Legal Director, Cindy
Cohn, has won a 2010 Intellectual Property Institute
Vanguard Award from the State Bar of California. Cindy was
one of four legal professionals honored for spearheading
new developments in the world of intellectual property.

EFF Updates

*Colbert's Word: Control-Self-Delete
Just a short time after his interview with EFF Legal
Director Cindy Cohn, American hero Stephen Colbert has
returned to the subject of digital rights, and he's come up
with a great solution to the problem of privacy and online
social networks: Control-Self-Delete.

* Facebook Should Stop Censoring Marijuana Legalization
 Campaign Ads
Facebook is engaging in another embarrassing episode of
censorship this week after refusing to show political ads
submitted by the Just Say Now marijuana legalization
campaign aimed a California ballot measure.  The situation
is an important reminder that social networks like Facebook
are "walled gardens" with overseers whose interests can
overwrite free speech, open communication, and in this
case, essential political debate.

* Jury Invalidates One of EFF's 'Most Wanted' Patents
A jury in the Eastern District of Texas in a case defended
by Google recently found one of EFF's "Most Wanted"
patents, the Firepond/Polaris patent invalid. This patent
was on EFF's "Most Wanted"  list because it claimed nothing
more than a system using natural language processing to
respond to customers' online inquires by email.

* Steve Jobs Is Watching You: Apple Seeking to Patent
 Spyware
While users were celebrating the new jailbreaking and
unlocking exemptions, Apple was quietly applying for a
patent on extremely creepy technology that, among other
things, would allow Apple to identify and punish users who
take advantage of those exemptions or otherwise tinker with
their devices.

* UPDATED: Security Researcher Arrested for Refusing to
  Disclose Anonymous Source
An Indian computer scientist who demonstrated the
vulnerabilities in India's paperless electronic voting
machines was arrested last weekend after he refused to
disclose who gave him the machine. Rather than face the
problems in their voting equipment, Indian authorities have
charged the scientist with theft.

EFFector 23.23: EFF Urges Verizon to Investigate Etisalat's Certificate Authority

In our 545th issue:

* EFF TO VERIZON: ETISALAT CERTIFICATE AUTHORITY THREATENS
 WEB SECURITY

EFF's open letter urges Cybertrust, a division of Verizon,
to evaluate whether the trusted SSL CA certificate it
issued to United Arab Emirate-based Etisalat should be
revoked. Etisalat recently threatened to discontinue
service to BlackBerry users after Blackberry developer
Research in Motion refused to provide the UAE government
with surveillance back doors in its encryption services.
This follows a mislabeled firmware update to approximately
100,000 UAE BlackBerry subscribers that contained malicious
surveillance software in July 2009.

* Government Uses Social Networking Sites for More than

 NSA
EFF has asked the Ninth Circuit Court of Appeals to
reinstate our landmark case against the federal government
for wiretapping millions of ordinary Americans without
warrants. The District Court had dismissed the case in
January on the incorrect argument that, because so many
Americans have had their communications and communications
records illegally obtained by the government, no single
person has legal "standing" to challenge the ongoing
program of government surveillance.

phone "jailbreaking" -- modifying software to liberate
iPhones and other handsets to run applications from sources
other than those approved by the phone maker. Then she
discusses the renewal of a 2006 rule exempting cell phone
unlocking so handsets can be used with other
telecommunications carriers.

Posted via email from KayO.LA

Let's try this again

 KayO.LA

Friend — Yesterday, this e-mail got caught in many Gmail users' spam folders. We tracked down and fixed the problem — so I'm sending it again.

As you know, Google and Verizon are planning a corporate takeover of the Internet. They're getting a ton of heat for their proposal, but so far FCC Chairman Julius Genachowski has been silent. Please sign our letter urging the chairman to denounce Google and Verizon's evil pact and protect the open Internet.

The FCC Chairman needs to be reminded that Google and Verizon don't make public policy —  he does. He needs to hear from you.

Thanks,
Craig Aaron

SavetheInternet.com

Dear Friend,

On Monday, Google and Verizon made it official: Forget "Don't Be Evil" — they're planning a massive corporate takeover of the Internet.

Their deal was met with a deafening public outcry — with hundreds of thousands of angry letters rolling in, and everyone from Silicon Valley innovators to leading members of Congress weighing in against the dangerous pact.

But one man was strangely silent: FCC Chairman Julius Genachowski.

You'd think the chairman would have something to say, given that two of the biggest companies on the Internet want to put toll roads on the information superhighway, eliminate Net Neutrality on wireless networks, and turn the FCC into a toothless watchdog.

We think it's time Chairman Genachowski spoke up.

We think it's time he denounced this deal in no uncertain terms.

We think it's time he made clear that these behemoths can't write their own rules — because that's his job.

And we think it's time that he deliver on his promise to restore the FCC's authority to protect Internet users and make Net Neutrality the rule of the road — once and for all.

If you agree, add your name to our letter to Chairman Genachowski:

Dear Chairman Genachowski,

Google and Verizon's pact has sparked a massive public outcry. People are upset because we've seen what happens when we let big companies regulate themselves or hope they'll do the right thing.

Please denounce this deal and deliver on your promise to restore the FCC's authority to protect Internet users and make Net Neutrality the rule of the road.

We know such a move may not be popular on Wall Street or in Silicon Valley, but it's the kind of leadership we need now.

It's not up to Google and Verizon to make public policy. We're counting on you to save the Internet.

Chairman Genachowski has heard plenty from Google and Verizon. Now he needs to hear from you. Please sign the letter now.

Thank you,

Craig Aaron

P.S. Google let us down in striking this deal. But its betrayal has brought unprecedented attention to the need to protect the open Internet. We must keep the pressure on the FCC. Please forward this e-mail widely and share the letter on Facebook and Twitter.

* COURT REJECTS WARRANTLESS GPS TRACKING: EFF-ACLU
ARGUMENTS AGAINST ALWAYS-ON SURVEILLANCE WIN THE DAY

The U.S. Court of Appeals for the District of Columbia
Circuit firmly rejected government claims that federal
agents have an unfettered right to install Global
Positioning System (GPS) location-tracking devices on
anyone's car without a search warrant. The court agreed
with the amicus brief arguments propounded by EFF and the
ACLU of the National Capital Area, holding that
round-the-clock surveillance required a search warrant
based on probable cause.

EFF Updates

* EFF Urges Supreme Court to Block NASA'S Invasive
 Background Checks
EFF urged the United States Supreme Court to uphold
an appeals court decision that blocks invasive and
unnecessary background checks at the National Aeronautics
and Space Administration (NASA), arguing that the
over-collection of personal data puts employees' privacy at
risk.
https://www.eff.org/press/archives/2010/08/09

* Publisher, Former Partners Agree to Destroy Personal
 Information About Gay Customers
While this is a good outcome, the case highlights a problem
that we're likely to see again and again. Personal
information supplied to companies by consumers is a
valuable asset, and its possible sale to the highest bidder
will implicate the privacy of millions of people when those
companies are sold or go out of business.
https://www.eff.org/deeplinks/2010/08/publisher-former-partners-agree

* A Review of Verizon and Google's Net Neutrality Proposal
Reaction to Google and Verizon's joint proposal for a new
legislative framework for net neutrality have been swift
and often critical. While we agree with many aspects of
that criticism, we think their idea of a narrow grant of
power to the FCC to enforce neutrality within carefully
specified parameters deserves further consideration.

* Government Finds Uses for Social Networking Sites Beyond
 Investigations
A recently released study conducted by the Office of the
Director of National Intelligence reveals that, in addition
to using social networking sites for law enforcement
investigations, the government has been considering
using it for background checks in security clearances.

* Government Abuses Computer Crime Law to Boost Criminal
 Charges
EFF asked a federal appeals court to block the government's
attempt to wrongly expand federal computer crime law,
turning misdemeanor charges into felonies.

Google: Don't Be Evil

 KayO.LA

Dear Friend,

Late last week, news broke that a dangerous deal was being struck between Google and Verizon that could end the Internet as we know it.

So far, the public outcry has been massive – pushing the story to the front pages and pressuring the FCC to call off its closed-door talks with industry insiders.

We need to keep up the pressure. We need you to tell Google: Don’t Be Evil.

We're working with our allies at MoveOn.org Civic Action, Credo Action, ColorofChange.org and the Progressive Change Campaign Committee to deliver 250,000 signatures to Google this week.

Go here to sign our letter right now – and then forward this message to all your friends and get them to do the same.

Thanks,

Josh Silver

Dear Friend,

Google is about to cut a deal with Verizon that would end the Internet as we know it.

According to a front-page New York Times story, the deal allows “Verizon to speed some online content to Internet users more quickly if the content's creators are willing to pay for the privilege."

It would create fast Internet lanes for the largest corporations and slow lanes for the rest of us.

That’s why we’re starting a mass protest by Google users to stop these two companies from joining forces to sell out millions of people like us who use the Internet.

If Millions Join Our Call, We Can Stop this Deal: Tell Google, “Don’t Be Evil"

Google’s motto is supposed to be “Don’t Be Evil.” But this deal puts the company in bed with the devil.

From the beginning, the Internet has been a level playing field that allows everyone to connect to one another and the world of content available online -- whether it's ABC News or your cousin’s wedding video. There’s only one Internet, and it shouldn’t matter who your provider is or whether you're logging on from home or your cell phone.

This deal will change all of that, allowing Google and Verizon to pick what websites you can see over others. The result couldn't be bleaker for the future of the Internet and for free speech and independent voices online.

Founders Larry Page and Sergey Brin created Google to make information freely available to everyone online. But this deal is a complete reversal that abandons their core principles:

Sign this letter and tell Google’s founders:
“Your Verizon deal IS evil, and it must be stopped.”

It’s up to the millions of people who use Google every day to tell the company to do the right thing.

Google must walk away from this bad deal, and make sure Internet users everywhere can enjoy the entire open Internet wherever, whenever and however they want.

Thank you for taking action,

Josh Silver

P.S. Google and Verizon don’t make Internet policy. The FCC and Congress do. After you sign the letter, tell our public officials to step in and protect the public interest and not to be bullied by a few large corporations.
